This is the privacy statement of Royal BAM Group nv and its operating companies (hereinafter: BAM, AM or us). At AM, we respect your privacy. In this statement, we describe how AM handles the personal data of our customers, suppliers, business partners and other third parties. This Privacy Notice may be amended from time to time. The most recent version will be published on our website.

Personal data we process

Personal data is any information that can provide information about an identifiable natural person. AM processes your personal data because you make use of our services and/or because you provide them to us yourself.

Below you will find an overview of the personal data we process:


  • First and last name

  • Gender

  • Date of birth

  • Birthplace

  • Address

  • Telephone number

  • E-mail address

  • IP address

  • Information about your activities on our website

  • Internet browser and device type

  • Bank account

  • Marital status

  • Matrimonial property law

  • Identification (name and number)

  • Other personal data that you provide, for example by creating a profile on this or another website, by e-mail, by app or by telephone.

  • Special and/or sensitive personal data that we process

AM processes the following special and/or sensitive personal data about you:


  • credit check

  • integrity check.

For certain transactions, we have the creditworthiness and/or integrity of our customers, suppliers and business partners checked. We do this by providing personal data (including address details) to an agency, which may only use this data for this purpose.

Goals and principles

AM processes your personal data for the following purposes:


  • Sending you a newsletter and other publications.

  • To be able to call or email or send you a message through an app or provide information on a website or an app.

  • Inform you about (changes to) services and products.

  • Provide you with the ability to create an account and post or exchange information on a website or app.

  • Offering products and/or services and/or information about products and/or services

  • Assessing and accepting you as a customer, supplier, business partner or other third party for the purpose of entering into a relationship with you or entering into a contract with you.

  • Entering into and performing a contract with you.

  • Entering into and performing agreements with a supplier, business partner or other third party in connection with the performance of a contract with you.

  • The development, control and improvement of our products and services.

  • For (market) research, trend analyses, customer profiles and statistical research, in which data is anonymised or can no longer be traced back to an identifiable natural person.

  • Execution of business processes, (internal) management and (management) reports

  • To promote safety, security, health and/or integrity.

  • To analyse your behaviour on the website or an app in order to possibly improve the website or the app and/or to tailor the range of products and services to your preferences.

  • To track your surfing behavior across various websites with which we may be able to improve our products and services and/or tailor them to your preferences.

  • To comply with a legal obligation.

The bases for the processing of your personal data are, depending on the case, the necessity of that processing for the conclusion and performance of a contract with you, for compliance with a legal obligation, to protect the vital interests of you or another natural person or for the protection of the legitimate interests of AM or our partners, unless your interests, fundamental rights or freedoms outweigh them.

Automated decision-making

AM can use automated tools to make decisions about individuals. However, we will not base decisions that have a negative outcome for you solely on the results of such an automated instrument. This exception shall not apply if:


  1. The use of automated tools is necessary for the performance of a task that must be performed in order to comply with legislation or that is required by law; or

  2. The decision has been taken by AM in order to enter into or perform a contract with you; or

  3. You have given your explicit consent.

These exceptions do not apply to the processing of special or sensitive personal data.

In the cases referred to in points (ii) and (iii), AM will take appropriate measures to safeguard your legitimate interests, for example by giving you the opportunity to express your opinion.

Retention periods

AM will only retain your personal data for as long as necessary to achieve the purposes for which your data is collected and/or to pursue AM's legitimate interests, such as compliance with statutory retention periods. If AM no longer needs the data for the aforementioned purposes, AM may retain the data for archiving and possible legal proceedings.

If we process your personal data to answer a question from you, we will retain that data so that we can answer any follow-up questions or deal with any complaint.

Sharing personal data with third parties

AM will share your personal data with various third parties, including other BAM operating companies, if this is necessary for the conclusion and performance of an agreement with you, or is necessary for another purpose described above. This may include, for example, ICT service providers, accountants, brokers, mortgage brokers, advisors, the SWK, civil-law notaries, suppliers, (sub)contractors and business partners, such as a company in which AM participates. We enter into a processing agreement with third parties who process your data on our behalf or make agreements to ensure the same level of security and confidentiality of your data. AM remains responsible for this processing. In addition, AM provides your personal data to third parties who are also controllers and as such are obliged to comply with legal obligations in relation to privacy. In such cases, AM may enter into a non-disclosure agreement.

Cookies and similar techniques

AM uses functional, analytical and tracking cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website. AM uses cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferred settings are remembered. Viewing, modifying or deleting data

You have the right to access, correct or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by AM and you have the right to the portability of your data. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or to an organisation named by you.

You can send a request for access, correction, deletion or transfer of your personal data or a request for withdrawal of your consent to or objection to the processing of your personal data to privacy@bam.com.

To ensure that the request has been made by you, we may ask you for proof of identity. We will respond to your request as soon as possible, but in any case within four weeks.

Deletion of your personal data is only possible if that data is no longer relevant.

Complaints procedures

If you have a complaint about compliance with this privacy statement or about a violation of your rights under the law, you can contact the Data Protection Officer.

Security

AM takes the protection of your data seriously and takes appropriate technical, physical and organisational measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. This is done, among other things, by means of the IT security policy, by training employees and by using secure storage and connections.
